These Terms and Conditions ("Terms") govern the sale and supply of steel wall bracing products and services by AusBrace ("we", "us", "our") to customers ("you", "your"). By placing an order or purchasing our products, you agree to be bound by these Terms.
We endeavour to ensure all product information, specifications, and technical data are accurate. However, we reserve the right to correct errors and update product information without prior notice.
All technical specifications are provided as guidance only. Customers must verify suitability for their specific application and ensure compliance with local building codes and engineering requirements.
We recommend consulting with a qualified structural engineer or building professional before specifying our products for your project.
Orders are subject to acceptance by AusBrace. We reserve the right to decline orders at our discretion, including for reasons of product availability, credit approval, or shipping restrictions.
All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice. Shipping costs are additional and calculated at checkout.
Payment is due upon order placement for retail customers. Commercial customers may be eligible for approved credit terms. We accept major credit cards, bank transfers, and other approved payment methods.
Delivery timeframes are estimates only and not guaranteed. We will make reasonable efforts to meet estimated delivery dates but accept no liability for delays caused by factors beyond our control.
Risk and title to goods pass to the customer upon delivery to the nominated delivery address or collection point. Customers are responsible for inspecting goods upon delivery.
Any damage or shortages must be noted on the delivery receipt and reported to us within 24 hours of delivery. Failure to report issues within this timeframe may affect product guarantee claims.
AusBrace products are covered by our product guarantee against manufacturing defects for the period specified in our guarantee documentation. This guarantee does not cover normal wear, misuse, or installation errors.
This product guarantee is in addition to any consumer guarantees, rights, or remedies that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law.
Returns may be accepted for unused products in original packaging within 30 days of delivery, subject to our approval and restocking fees. Custom or cut-to-length products cannot be returned.
Product guarantee claims must be submitted with proof of purchase and detailed documentation of the alleged defect. We reserve the right to inspect products before authorizing returns or replacements.
Our total liability for any claim arising from or related to these Terms or our products is limited to the purchase price of the specific products giving rise to the claim.
We exclude liability for any indirect, consequential, or special damages including but not limited to lost profits, business interruption, or project delays.
Customers are responsible for ensuring our products are suitable for their intended application and comply with applicable building codes and engineering requirements.
All intellectual property rights in our products, designs, technical documentation, and website content remain our property. Customers may not reproduce, distribute, or create derivative works without our written consent.
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of Queensland courts.
We may modify these Terms at any time by posting updated terms on our website. Continued use of our services after modifications constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
